By accessing or using our services, you agree to these T&Cs. 1.4. We may update these T&Cs from time to time. The latest version will be available on our website. Continued use of our services constitutes acceptance of the updated T&Cs.
2. Definitions 2.1. "Services" refers to the virtual functional medicine consultations and related services provided by The Magnolia Clinic. 2.2. "Patient" refers to any individual who uses our services.
3. Services Provided 3.1. We offer virtual consultations and personalized health plans. 3.2. Our services are for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. 3.3. We do not guarantee specific results from our services.
4. Medical Disclaimer 4.1. Our services are for informational purposes only. We cannot diagnose, treat, or cure medical conditions. Always consult with your GP for diagnosis and treatment of any medical condition. We do not replace other hospital or GP treatment, nor do we replace conventional, alternative, or complementary therapies like Chinese medicine. If, at any stage, medication changes become necessary, we will (with your permission) write to your GP requesting these adjustments, but only if they agree to make the changes. 4.2. Our services are not a substitute for professional medical advice, diagnosis, or treatment. 4.3. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.
5. User Responsibilities 5.1. You agree to provide accurate and complete information when using our services. 5.2. You agree to follow any treatment plans and recommendations provided. 5.3. You agree not to use our services for any unlawful purpose.
6. Communication with Your GP 6.1. To ensure coordinated care, we seek your explicit consent to share information with your GP regarding your treatment plan at The Magnolia Clinic.
7. Informed Consent 7.1. By using our services, you acknowledge and agree to the limitations outlined above. You also agree to keep your GP informed about your participation in our program.
8. Empowerment and Shared Responsibility 8.1. The Magnolia Clinic is committed to empowering you to take charge of your health. We believe your commitment, contribution, and dedication are key factors in achieving your health goals. Since everyone's body is unique, we cannot guarantee specific outcomes from our assessments and recommendations. 8.2. Your baseline health condition, its duration, and your individual response to various treatment approaches all influence the results and timelines. Our role is to provide you with technical, scientific, and medical support to empower you on your health journey. This is a collaborative effort, and most of the work will be done outside of consultations. To achieve success, you will be the primary driver of your well-being and will need to take full responsibility for your choices and overall health outcomes.
9. Appointment Booking and Cancellation Policy 9.1. Appointments: You can book appointments online. We will confirm your appointment details by email on the next business day. 9.2. Cancellation by You: We require at least 3 business days' notice for appointment cancellation. Cancellations with less than 3 business days' notice may incur a full fee. Rescheduling more than 3 times may incur a £25 fee. Cancellations outside the timeframe will receive a refund minus a £10 admin fee (processing time 5-10 days). 9.3. Cancellation by Us: We reserve the right to cancel appointments due to unforeseen circumstances. We will not charge for cancelled appointments on our end.
10. Email Policy 10.1. Due to high volume, emails requiring medical advice may require a brief consultation. We strive to answer simple inquiries within 2 business days.
11. Complaints 11.1. We value your feedback. If you have any concerns, please contact The Magnolia Clinic via the “Contact Us” page on the website.
12. Privacy and Data Protection 12.1. We comply with the General Data Protection Regulation (GDPR). 12.2. We collect, use, and store personal data as described in our Privacy Policy [link to Privacy Policy]. 12.3. We maintain patient confidentiality in accordance with applicable laws.
13. Supplement Use 13.1. We may recommend nutritional supplements to support your health goals. However, these can interact with medications. It's crucial to keep all your healthcare providers informed about any medications, supplements, herbs, or hormones you take. We recommend continuing with medications and treatment plans prescribed by your specialists and GP until our interventions allow for safe adjustments. We will always advise you to discuss any medication changes with your GP before stopping anything. 13.2. We offer a discount code for supplements purchased through our partner companies. These companies provide us with a small referral fee and offer you a discount. If you find the same product elsewhere for less, please purchase there. Ensure it's the exact brand and formulation, as supplement quality varies.
14. Sharing Information 14.1. To support your ongoing healthcare, your practitioner may need to share some information with third parties, such as pharmacies to dispense medications or laboratories for testing. We will only share information on a need-to-know basis. Occasionally, we may discuss unexpected test results with laboratory experts, some of whom may be located outside the UK. Internally, we hold regular clinical meetings to review complex cases and improve outcomes for our patients. During these meetings, we share information but not contact details.
15. Limitation of Liability 15.1. To the fullest extent permitted by law, The Magnolia Clinic shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of our services. 15.2. Our total liability to you for any claims arising out of or in connection with our services shall not exceed the amount paid by you for the services in question.
16. Indemnification 16.1. You agree to indemnify, defend, and hold harmless The Magnolia Clinic, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of our services, violation of these T&Cs, or infringement by you of any intellectual property or other right of any person or entity.
17. Intellectual Property 17.1. All content provided by The Magnolia Clinic, including text, graphics, logos, and software, is the property of The Magnolia Clinic and protected by intellectual property laws. 17.2. You may not use any content from our services without our prior written consent.
18. Termination 18.1. We reserve the right to terminate your access to our services at any time, without notice, for any reason, including if we believe you have violated these T&Cs. 18.2. Upon termination, all provisions of these T&Cs which by their nature should survive termination shall survive.
19. Dispute Resolution 19.1. These T&Cs are governed by and construed in accordance with the laws of the United Kingdom. 19.2. Any disputes arising under or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the courts of the United Kingdom. 19.3. Before pursuing legal action, you agree to attempt to resolve any dispute through mediation or arbitration.
20. Miscellaneous 20.1. These T&Cs constitute the entire agreement between you and The Magnolia Clinic regarding your use of our services. 20.2. If any provision of these T&Cs is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 20.3. No waiver of any term or condition of these T&Cs shall be deemed a further or continuing waiver of such term or condition or any other term or condition. 20.4. We shall not be liable for any failure or delay in performing our obligations under these T&Cs due to circumstances beyond our reasonable control.
